James Trail represents commercial clients in complex litigation concerning a wide variety of subject matters, with a particular emphasis on real estate-related matters, fraudulent conduct, contractual disputes, construction disputes and commercial workouts. James is also adept at resolving disputes before and after trial, through alternative dispute resolution methods and in post-judgment appellate proceedings.

  • Defended action to foreclose upon mortgage and obtained dismissal, with prejudice, within 6 months of complaint being filed.
  • Defended and obtained dismissal, with prejudice to refile in Illinois, of class-action lawsuit based upon forum-selection clauses and in favor of defendants that were non-signatories to the subject agreement.
  • Represented and obtained summary judgment in favor of real estate entity in multimillion-dollar partnership dispute.

  • Defended action alleging misappropriation and trade secret violations, including emergency injunction requests, and obtained dismissal, with prejudice, within 8 months of complaint being filed.
